Interaction between Global and Regional Ocean Governance: Three Models

The objective of this chapter is to examine the relationship between regional and global governance from the viewpoints of the international law of the sea. This chapter analyses three models regarding legal frameworks governing the oceans: the global model, the regional model and the global-regional model. Under the global model, maritime issues are to be regulated by the global legal framework created by the UN Convention on the Law of the Sea. By contrast, under the regional model, the role of global legal framework remains modest and, instead, regional legal frameworks assume considerable importance. Under the global-regional model, the global and regional legal frameworks perform in a mutually complementary manner. Currently each model encounters challenges.
