International Courts and Megapolitics

Scholars, judges, lawyers and politicians often lament the judicialization of politics. Yet wherever independent courts operate, some level of judicialization is unavoidable. This research’s focus is on the more extreme variant of this politicization, the judicialization of mega-politics and the role international adjudicatory bodies play in these politics.

THE PROJECT IS CLOSED
Project period: 2019-2022

This project explores three different sources of internationalized mega-politics: 1) disputes that involve two or more states with strongly divergent preferences; 2) international disputes involving legal issues that divide domestic; and 3) disputes that are contentious mostly because international adjudicators are piercing the veil of sovereignty, which may primarily or especially incense executive actors (e.g. governments).
