Analyzing the Judgements of the European Court of Justice as Cultural Artefacts

Judgements of the European Court of Justice cannot only be analyzed as a bundle of rules to be classified (formalist school), as a bundle of social policies to be assessed (economic school), or as a bundle of philosophical principles to be measured against (hermeneutical school). They can also be analyzed as cultural artifacts, which can give expression to a wide variety of unchartered human storylines about the culture from which they arise (law and literature school). Through conceptualizing the judgments of the European Court of Justice in this way, this project aims to open new windows into the reality of the European Union polity and thereby unveil storylines about its culture that go beyond those offered by mainstream interpretations.

For these purposes, this project will analyze and assess the jurisprudence of the European Court of Justice in different fields of European Union law, such as labor law, citizenship law, gender equality law, digital rights law, and external relations law. It will thereby employ an innovative combination of qualitative research methods drawing from insights of the law and literature scholarship as well as from political and moral philosophy.
