It is difficult to exaggerate the importance of analogy in international investment law. With many unique characteristics and challenges, international investment law naturally invites comparisons with other, more developed areas of international and domestic law. Yet, while analogies may help us make sense of the field, the way in which they are chosen and employed can have significant and perhaps unintended consequences. This observation constitutes the underlying assumption of Valentina Vadi’s Analogies in International Investment Law and Arbitration and is but one of the reasons why this study is particularly significant.
