Beyond the Judgment: Greece’s Reverse Strategic Litigation in the Implementation of Pushback Cases

This presentation examines how Greece engages in reverse strategic litigation during the implementation of European Court of Human Rights judgments on migrant pushbacks. Rather than complying with findings against it, Greece strategically frames violations as isolated incidents to avoid structural reforms, enhanced supervision, and broader accountability. By analyzing recent cases such as Safi and Others, the paper highlights how governments shape human rights law not only in the courtroom but also in the post-judgment phase and argues for clearer implementation expectations to strengthen migrant rights protection.
