Legal Euroscepticism. How Right-Wing Eurosceptics Turn National Law Against European Integration
Abstract:
Right-Wing Eurosceptics often propose national withdrawal from European integration organizations. But this is not their only strategy, sometimes not even their preferred one. Instead, frequently, they seek to turn national law against European institutions. The CJEU and the principle of primacy, in particular, have been preferential objects of these attacks. This work-in-progress workshop will explore this topic. Using a database of national election manifestos of right-wing Eurosceptic parties between 2009 and 2021, the workshop will explore three dimensions of this phenomenon. First, the concept of 'legal Euroscepticism' will be proposed as an analytical tool to understand these strategies. Second, legal-Eurosceptic proposals in the manifestos covered will be presented and analysed. Third, a typology of parties using strategies of legal Euroscepticism will be put forward.

Dr Pablo Castillo-Ortiz is a Senior Lecturer in Law at the University of Sheffield (UK). He develops interdisciplinary law and politics research about constitutional courts and organs for judicial governance, and about their role in democratic systems and in processes of regional integration (with a focus on the European Union). His research has been published in leading outlets in the disciplines of law and political science (inter alia, European Constitutional Law Review, European Political Science Review, Journal of Law and Society, Comparative European Politics).
At iCourts, Pablo will be researching European far right parties and their position on the primacy of European Union law. To do so, Pablo is carrying out a comprehensive scrutiny of the election manifestos of far right parties in all European Union Member States in the last two decades. The research carried out combines a doctrinal analysis of the positions of these parties about the issue of primacy, an empirical analysis explaining under which conditions these parties resource to sceptic approaches to EU law, and a policy analysis of the implications of this phenomenon for the future of the process of European Integration.
