The project seeks to analyze the Commission’s approach on merger remedies. Traditionally, it has favored structural remedies but a change has occurred. The project focuses on the reasons behind this change. Perhaps the Commission has realized the potential of behavioral remedies in general, or maybe behavioral remedies have benefits compared to structural ones in certain situations and/or within certain areas, e.g. small jurisdictions and the high-tech sector. The project examines the Commission’s merger decisions, as well as scholarly opinions within the field, with the aim to identify interpretation changes and improvement potential regarding the regulation and its implementation. The research also includes comparative research into the US subject approach.
