A Comparative Study on the Protection of Geographical Indications in China and Europe
Jianaer Zainula is financed by the Chinese Research Council and will be writing a PhD-thesis on Geographical Indications as seen from Chinese and EU perspectives.
The protection system of geographical indications (GIs) originated in Europe and has been established as reference value internationally. China is preparing to draft the "Special Law on the Protection of Geographical Indications" and there is an urgent need to integrate and establish a unified special law for GIs. China protects GIs via a dual system. This system results in independence and a lack of cooperation and support between the international legislation of GIs which results in disturbances to the protection of GIs.
This project compares the protective legislation of GIs in China and Europe, which includes;
- an analysis of the reasons for the difference from a theoretical, historical, and practical perspective
- an analysis of the shortcomings of China's existing protection model
- the advantages of the EU legislation
- a proposal of new ideas and theoretical support for China to enact a Special Law on the Protection of Geographical Indications
