Modifications of contracts in Denmark

The Chapter deals with modification of contracts in Denmark. Article 72 of the 2014 Procurement Directive has been rewritten into six paragraphs in the Public Procurement Act (§§178-184). Like at EU level, this was also the first time modification of contracts was regulated at national level in Denmark. There are no additional rules allowing for other types of modification in contracts than those we find in the Directive. The interpretation of the rules on contract modifications has mainly taken place though case law from the Danish Complaints Board as well as case law from the CJEU. Material contract changes are considered as direct award, leading to ineffectiveness.
