Risk and Causation in the Responsibility System of the European Convention on Human Rights

Vladislava Stoyanova is Associate Professor in Public International Law, Faculty of Law, Lund University. She is the author of Positive Obligations under the European Convention on Human Rights, which if published by Oxford University Press. Access her full publication list. 

In her talk, Stoyanova will explain how ‘risk’ has gained a key importance in the reasoning of the European Court of Human Rights when the Court determines breach of positive obligations. Stoyanova’s analysis will be the first attempt to explore the concept of risk as used by the Court, to check for coherence and to explain what it implies for the responsibility of States under the Convention system. In particular, Stoyanova argues that ‘risk’ reorientates the responsibility system under the ECHR in important interrelated ways.

The International Law Breakfast Briefings offer a regular opportunity for researchers, practitioners, and students with an interest in international law to meet, exchange views, and share research findings on current issues in the field.

Format: Each session features a presentation of approximately 20-25 minutes, followed by a discussion. Unless otherwise specified, both the presentation and discussion will be conducted in English.
