Advocate General refers to CEPRI research

Advocate General Szpunar recently delivered his Opinion in case C-641/18 (Rina), which includes several references to research by professor Vibe Ulfbeck (head of CEPRI) and Anders Møllmann on public function liability of classification societies, which was published in the book “Certification – Trust, Accountability, Liability” (Springer 2019). This research examines liability issues with regard to the certification carried out by vessel classification societies exercising  public functions, and it describes how the application of private law faces different challenges in this situation and how the line drawn between the private and public functions of classification societies is becoming increasingly blurred.
