The Due Diligence Obligations of States in Cyberspace

The principle of due diligence is a general rule of customary international law prescribing that States must exercise ‘due diligence’ to ensure that violations of other States’ international legal rights do not emanate from their territories. In this presentation, the speakers will address the topical question of the application of the due diligence principle in the cyber domain. Specifically, the speakers will examine the extent to which States are obliged to prevent hostile cyber activities directed at other States.

About the speakers

Marc Schack is Assistant Professor at the Institute for Military Operations, Royal Danish Defence Academy. Astrid Kjeldgaard-Pedersen is Professor with special responsibilities in International Law at iCourts, Faculty of Law, University of Copenhagen.
