Is it Time to “Kill” the Law of the Sea Convention? The Living Treaty Approach as a Shield Against Transformative Change

In this presentation, César will share some conclusions from his PhD research on the long-term future of the law of the sea. In particular, he will present the claim that UNCLOS itself may be one of the greatest obstacles to transformative change in ocean governance. He will also explore the prospect of UNCLOS's decline and eventual "death" as a necessary critical exercise that opens space to reimagine the future of the law of the sea amid the deepening ecological crisis in the world's oceans.
About the speaker
César Soares de Oliveira is a legal scholar who specialises in applying theoretical debates within public international law to specific areas in international environmental law. In particular, his research interests lie in the Law of the Sea, Ecological Law, Polar Law, and the study of coherence and consistency within international environmental regimes. He also has a general interest in comparative legal history and the Law of Treaties.
