Abstract
In view of the EU’s resource consumption footprint, EU waste law has committed to a Circular Economy (CE) transition. Whereas in a linear resource consumption model of take-make-waste the value of resources is annulled in their waste phase, a CE model valorises waste as a source of secondary resources that can substitute virgin ones in the internal market. However, secondary resources cannot be placed in the market if they still pose environmental and public health risks pertaining to a latent waste status. To strike a balance between reduced consumption footprint and safe secondary resources, at least two factors are important: (a) addressing knowledge gaps about waste materiality and its risks and (b) channeling this knowledge towards harmonized safety criteria for secondary resources placed in the internal market. Regrettably, the structure of EU waste law fails to incorporate these crucial factors.
About the speaker
Dimitrios is a PhD candidate at the Law Department of European University Institute (EUI), Florence. His PhD topic is titled ‘Opting for the wrong loops: persistent problems of EU waste law in the Circular Economy transition’. He is interested in the intersections between waste law and chemicals law and more broadly in the nexus between environmental, risk and AI regulation. He also holds a Master of Science from Leiden University, Netherlands in the field of Comparative Criminal Justice. His master thesis concerned the victim status of entities plagued by waste crime and it is published open access: Who qualifies as an environmental victim? A cross-jurisdictional case-study in the waste sector.
