Marine genetic resources in areas beyond national jurisdiction: can we consider the new regime under the BBNJ Agreement a solution to the existent legal gaps?

About the seminar

The legal regime of marine genetic resources (MGR) located in areas beyond national jurisdiction has been studied and discussed for a long time in the literature. The international community, for the last twenty years, has been trying to fill the existent legal gaps in this matter with the adoption of a new implementing instrument of the United Nations Convention on the Law of the Sea, which was adopted in 2023, and is popularly known as the BBNJ Agreement. The seminar will be part of the presenter’s ongoing doctoral research and it will focus on the new regime that will be adopted for MGR under the BBNJ Agreement, framing it in the context of the negotiations and the positions that have been taken by the different delegations throughout the years.

About the speaker

María Carro Pitarch is a PhD Candidate in International Law and a Lecturer of EU Law in the University of Valencia. She is the holder of a Jean Monnet Module on the environmental challenges for the European Union (Project ENVEU). She holds an LLM in European Law from the College of Europe, an LLM in Legal Practice from the UNED, and a Double Bachelor’s in Law and Business Administration from the University of Valencia.
