My research in procedural law concerns, in particular:

  • Preliminary injunctions
  • Collection and seizure of evidence
  • The role of non-legal experts in civil litigation
  • Jura novit curia
  • Court mediation of civil disputes
  • Nordic reforms of the administration of civil justice
  • EU law and national procedural law
  • Alternative Dispute Resolution (ADR), including arbitration and "notice-and-action" procedures
  • The Internet Domain Names Act, including the Danish Complaints Board for Internet Domain Names and "good domain name practice" (god domænenavnsskik)
  • Enforcement of intellectual property rights, including injunctions, collection of evidence, right to information, damages, penal sanctions and corrective enforcement measures as well as the EU Customs Regulation
  • The Unified Patent Court (UPC), including its institutional setup and procedural law
  • European Commission project JUST/2014/RCON/PR/CIVI/0082 - Study of national procedural laws and practices in terms of their impact on the free circulation on judgments and on the equivalence and effectiveness of the procedural protection of consumers under EU Consumer Law, led by Max Planck Institute Luxembourg, 2016 national reporter (Denmark)

I am member of the research Centre for Enterprise Liability (www.cevia.dk) and associated member of the research Centre for Information and Innovation Law (www.ciir.dk).

I am currently principal supervisor for two PhD students:

  • Toms Krumins: The interaction between international commercial arbitration and court litigation: court involvement and parallel processes
  • Vadym Semenov: Enforcement of Standard Essential Patents in the Unified Patent Court

Other areas of interest

  • Intellectual property law, in particular trade mark law, law governing internet domain names and copyright law
  • Contracts, in particular publishing agreements, license agreements, R&D agreements etc.

Responsible conduct of research

I teach and advice researchers, including PhD students, on research ethics at the University of Copenhagen (faculties of law, social sciences and humanities) and as consultant and teacher for the Committee for Protection of Scholarly and Scientific Works (Udvalget til Beskyttelse af Videnskabeligt Arbejde, www.ubva.dk). I am co-editor and co-author of www.forskerportalen.dk.

In 2014, professor Morten Rosenmeier and I were appointed as Named Persons to support good scientific practice at the University of Copenhagen, Faculty of Law.

Teaching

Clement Salung Petersen teaches the following courses:

  • Civil procedure (LL.M. programme)
  • Good scientific practice (PhD programme at the Faculties of Law and Sociel Sciences)
  • Quality in legal scholarship (PhD programme at the Faculty of Law)

I have previously also taught property law and intellectual property (IP) law.
