New paper by David Thór Björgvinsson

The paper addresses the question how fundamental rights are protected under the EEA Agreement. IIt is asserted that fundamental rights, as reflected in the ECHR and the case law of the Court, form a part of the unwritten principles of EEA law. This is supported by reference to the fundamental aims of the EEA Agreement, the case law of the EFTA Court and, with some reservations, by a specific reference to Article 6 EEA and Article 3 ESA/Court Agreement referring to the relevance of the case law of the CJEU for the enforcement of the EEA Agreement.
