    The research proposal highlights the issue of compulsory licensing in the field of patented pharmaceutical products which has been in the forefront of fierce academic and political debate for many years, following the enactment of the TRIPS Agreement and the subsequent Doha Ministerial Declaration on the TRIPS Agreement and Public Health. The relevance and actuality of the topic of the thesis is reaffirmed by the recent United Nations Secretary General’s High Level Panel on Access to Medicines and its final report, stressing that ‘complementary tools to intellectual property laws, such as competition law, provide an important marketstabilizing effect on anti-competitive behaviour…Relating to intellectual property, anticompetitive practices might include excessive pricing’. The project conducts an investigation of the triangular dilemma of strong Intellectual Property protection, contra high prices of medicines as result of the said global Intellectual Property regime and finally the legal-economic rationales and discourses underlying competition law / intervention. The aim is to establish what constitutes anti-competitive practices such as excessive prices in mainly US and EU legal tradition, but also drawing on legislation and case law in some selected developing countries, by making the case for the excessiveness of prices as an anti-competitive practice in and out of themselves from a legal-economic / competition law perspective.
