Intro: Begrebet "had" har en lang idéhistorie i europæisk etik og retskultur. Ligesom vrede og hævn er had et af de helt uomgængelige begreber i overvejelser vedrørende den plads, som følelser kan eller bør have i strafferetlig teori og praksis. I dette oplæg vil Thomas Brudholm se nærmere på hvad "had" er kommet til at betyde i nyere amerikansk og europæisk tænkning og retspraksis vedrørende hadforbrydelser og "hate speech".

Towards a Theatrical Jurisprudence (på engelsk)

Intro: In terms of a legal account of human conduct, the theatrical shows – dramatically perhaps - that the narrative certainty and completeness through which human interaction is conceived is artifice. Law assumes that our actions and conduct, our behaviours and practices function textually. The theatrical shows that law deploys extraordinary measures to impose narrative certainties over the sheer randomness and meaningless of the events, actions and interactions that litter human existence, and as such assume the existence of a literary necessity in everything that occurs. I am posing an alternative reading of law’s interactions premised on the theatrical which asks us to see the encounter as a response of the body as physical, visceral and corporeal - and not of the mind or will. The theatrical thus functions in a different register from performance or the performative because of their implicit reliance upon the existence of a preformed textuality or intentionality.
