New article in European Constitutional Law Review by Helle Krunke, CECS

Helle KrunkeThe Lisbon judgment is analysed in a 30 pages article. The main legal question in the Supreme Court judgment of 20 February 2013 was which procedure Denmark should have followed for approving the Lisbon Treaty. However, the article also covers some broader questions which the case raises about the separation of powers between the legislature and the courts, about the role of the people and the concept of democracy, about constitutional interpretation (and how and who should interpret), about the grey areas between political and legal statements, about constitutional identity and about the need for constitutional revision.
